In Canada, divorce is governed through federal legislation called the Divorce Act. It also covers child support and spousal support but leaves issues related to property division to the provinces and territories. If you and your spouse separated on or after January 1, 2020, Alberta’s Family Property Act covers your division of property and debt. (For separations before this date, the Matrimonial Property Act applies.)

There are three reasons by which a marriage can break down: separation, adultery, and cruelty. Most people are divorced in Canada on the no fault grounds of one year’s separation. Uncontested divorces are when spouses agree to get divorced and already have written agreements or court orders to deal with specific issues (like parenting, property division, and child or spousal support). Contested divorces are when spouses do not agree on all relevant issues and must go to court or attend some form of dispute resolution.

You may be able to avoid a costly trial through mediation or arbitration processes. A neutral third party will help you and your partner determine a path forward. Our expertise can be helpful as you navigate these options to seek a resolution.
